General Terms and Conditions of Sale (GTC)

§ 1 Scope of Application
These terms and conditions apply to all purchases from vigepe Verlag made by private customers. Private customers in this sense are persons with residence and delivery address in the Federal Republic of Germany, as far as the goods ordered by them cannot be attributed to their commercial or independent professional activity. Business customers are requested to contact us for orders.

§ 3 Conclusion of contract
The presentation of our goods and the granting of the possibility to place an order does not constitute a binding offer on our part. Only your order represents an offer to us to conclude a purchase contract. If you place an order with us, we will send you an e-mail to the e-mail address you provided, confirming receipt of your order and listing its details (order confirmation). The contract is concluded with the sending of this order confirmation.

§ 4 Right of withdrawal
Consumers have a two-week right of revocation. Cancellation policy Right of cancellation You can cancel your contract within 14 days without giving reasons in writing (eg letter, fax, e-mail) or - if the goods before the deadline - by returning the goods. The period begins after receipt of this notification in writing, but not before receipt of the goods by the consignee (in the case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also does not fulfill our obligations to provide information pursuant to Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB. The timely dispatch of the revocation or the goods shall be sufficient to comply with the revocation period. The revocation is to be sent to:

4 a) Consequences of revocation
In the event of an effective revocation, the services received by both parties shall be returned and any benefits derived (e.g. interest) shall be surrendered. If you are unable to return or surrender the received performance and benefits (e.g. benefits of use), or are only able to do so in part or in a deteriorated condition, you must compensate us for the loss of value. You only have to compensate us for the deterioration of the goods and for any use made of them if the use or deterioration is due to handling of the goods that goes beyond the examination of the characteristics and functioning of the goods. By "testing the properties and functionality" we mean testing and trying out the respective goods, such as is possible and customary in a retail store. Goods that can be shipped by parcel are to be returned at our risk. You have to bear the regular costs of the return if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of 40 € or if, in case of a higher price of the goods, you have not yet provided the consideration or a contractually agreed partial payment at the time of the revocation. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the goods, for us with their receipt.

4 b) End of the cancellation policy
The right of revocation does not apply to deliveries of goods that are manufactured according to your customer specifications (e.g. books with signature and/or dedication - books whose protective foil has been removed) or are clearly tailored to personal needs.

4 c) Return costs when exercising the right of withdrawal. If you make use of your legal right of revocation (see revocation instruction), you have to bear the regular costs of the return as well as of the previous sending, if the delivered goods correspond to the ordered ones.

§ 5 Prices and shipping costs
The excellent prices are final prices including sales tax. In addition, the shipping costs per order within Germany are indicated, but depend on the size and weight of your order. Orders that require a higher postage will only become effective after we have communicated the shipping costs and these have been confirmed by the customer. From a value of goods of 1.500,00 € per order, we deliver free of shipping costs.

§ 6 Payment
Payment shall be made by invoice, advance payment or payment in arrears.

§ 7 Favorable shipping method for returns
(1) When returning the goods and accessories, please use the original packaging if possible, even if this should be damaged by an opening for functional testing. You are not obliged to do so, but by returning the goods in the original packaging you can prevent us from having to claim compensation from you for the missing original packaging.

(2) Please use a prepaid shipment when returning goods. You are under no obligation to use this return method. However, if you choose an unnecessarily expensive shipping method, you may be obligated to pay us the increased costs compared to an inexpensive shipping method.

§ 6 Retention of title
The goods remain our property until full payment has been made.

§ 7 Place of jurisdiction
If, contrary to the information you provided when placing your order, you do not have a place of residence in the Federal Republic of Germany, or if you transfer your place of residence abroad after conclusion of the contract, or if your place of residence is not known at the time the action is filed, the place of jurisdiction for all disputes arising from and in connection with the contractual relationship shall be Hüttenkofen.
